The term “Sexual Harassment” means conduct on the basis of sex, sex stereotypes, sex characteristics, pregnancy or related conditions, sexual orientation, gender identity, or gender expression that constitutes Quid Pro Quo Harassment, Hostile Environment Harassment, or Sexual Misconduct, all as defined in this policy.

The term “Hostile Environment Harassment” means unwelcome conduct on the basis of sex that, based on the totality of the circumstances, is subjectively and objectively offensive and is so severe and/or pervasive that it limits or denies a person’s equal access to participate in or benefit from the University’s Education Program or Activity. Determining whether a Hostile Environment has been created is a fact-specific inquiry.
