ݮƵAPP Files Brief With Supreme Court in ‘Susan B. Anthony List v. Driehaus’

Yesterday, ݮƵAPP filed an amicus curiae (“friend of the court”) brief (PDF) with the Supreme Court of the United States in the case of . The case, which arrives at the Court on appeal from the United States Court of Appeals for the Sixth Circuit, involves a constitutional challenge to an Ohio law prohibiting “false statements” in electoral campaigns. ݮƵAPP’s brief argues that the Sixth Circuit erred in a First Amendment challenge to the law and warns that if the ruling is allowed to stand, college students and faculty whose speech is chilled by overly broad and vague speech codes will be denied the opportunity to seek judicial relief.

Jeffrey A. Rosen of Kirkland & Ellis LLP is counsel of record for ݮƵAPP, joined by John K. Crisham, Jennifer M. Bandy, and Michael A. Fragoso. ݮƵAPP is deeply grateful for their generous assistance.

We’ll have more analysis of the case and ݮƵAPP’s brief tomorrow.
