Michigan: Numerous municipalities maintain unconstitutional public comment policies
Cases
Case Overview
On February 6, 2025, ²ÝÝ®ÊÓƵAPP¹ÙÍø wrote to 20 Michigan cities about unconstitutional provisions in their public comment policies. The letters reminded each governing body that they lack authority to restrict the content of commenters’ speech unless those restrictions are viewpoint-neutral and reasonable. As each city maintains some provision that infringes its citizens’ First Amendment rights, ²ÝÝ®ÊÓƵAPP¹ÙÍø called on the cities to revise their policies.
